Definition & Distribution Guidelines for the U.S.
Note:
these guidelines are only valid for the United States.
Residents of other countries should check with their local
Microsoft subsidiary for academic pricing and
qualification information.
Microsoft Qualified
Educational User Definition (US Only)
All Microsoft Eligible Education Customers must be located
or reside in the United States. Microsoft Corporation
shall resolve any issues relating to the eligibility of
customers to purchase AE product at its sole discretion.
RESELLER must validate customer eligibility via collection
of a valid academic purchase order prior to all
distribution to Qualified Education Users. In the case of
distribution to Higher Education students, full time
faculty and staff of Education Institutions, RESELLER must
also collect and keep a proof of student enrollment or
employment from the Educational Institution. Proof of
enrollment must either be a copy of an official photo
identification card from the Education Institution or
official documentation from the Educational Institution's
registration office verifying that the individual is
matriculating student at the institution at the time of
purchase. If the official identification card does not
include a photo graph of the student, the copy of the
identification card must be accompanied by a second source
photo identification. Only Campus Resellers (must be
physically located on campus) are waived from keeping a
copy of valid ID once the Campus Reseller has verified
customer's eligibility. The following are eligible to
acquire the following Microsoft Academic Edition (AE)
products and are defined as Qualified Educational Users:
QUALIFIED USERS:

A)
Educational Institutions -- Defined as an
accredited K-12 education institution or higher education
institution organized and operated exclusively for purpose
of teaching its matriculating students. An accredited
institution must be:
- A public or private K-12, vocational school,
correspondence school, junior college, college,
university, or scientific or technical school meeting
all of the following criteria: (i) organized and
operated exclusively for purpose of teaching its
matriculating K-12 or higher education students; and
(ii) institutionally accredited by a Regional
Institutional Accrediting Agency recognized by the
U.S. Secretary of Education. Note: Accreditation by a
National Institutional and Specialized Accrediting
Body alone does not qualify an end user as a qualified
educational user.

time matriculated students of a higher education

(1)above. Full and Part Time Matriculated Students of K-12
are NOT Qualified Educational Users.

E)
Public Libraries -- Must meet all of the following
criteria: (i) provide general library services without
charge to all residents of a given community, district or
region; (ii) are supported by public or private funds;
(iii) make its basic collections and basic services
available to the population of its legal service area
without charges to individual users, but may impose
charges on users outside its legal service area; and (iv)
may or may not provide the products and services, beyond
its basic services, to the public at large with or without
individual charges.

F)
Public Museums -- Must meet all the following
criteria: (i) are a public or private agency or institution organized on a permanent basis for essentially

professional staff; and (iii) own or utilize tangible
objects, care for them and exhibit them to the public on a
regular basis.

Special note regarding
Hospitals, Healthcare Systems and Research Laboratories
Hospitals, healthcare systems and research laboratories
(e.g. independent research laboratories or research
laboratories affiliated with the Department of Defense or
the Department of Energy) are NOT eligible to acquire AE
products unless they are wholly owned and operated by a
qualified Educational Institution as defined above in this
Section A, and even if they
are wholly owned they are NOT eligible to purchase Campus
Agreement or School Agreement and are NOT eligible to be
included as part of an Educational Institution's Campus
Agreement or School Agreement. To be "Wholly owned
and operated" the entity must be owned, controlled,
and operated solely by the Educational Institution.
